These Terms & Conditions govern the sale of goods and digital products by Fervent Drift RPG & Fantasy Ltd through our website.
By placing an order through our website, you agree to these Terms & Conditions together with our Payment Policy, Shipping Policy, Privacy Policy, and Refunds & Returns Policy.
1. Who We Are
Fervent Drift RPG & Fantasy Ltd
61 Bridge Street
Kington
Herefordshire
HR5 3DJ
Email: contactus@ferventdriftrpg.com
Website: https://ferventdriftrpg.com
In these Terms & Conditions, “we”, “us”, and “our” mean Fervent Drift RPG & Fantasy Ltd. “You” and “your” mean the customer placing an order with us.
2. About These Terms
These Terms & Conditions apply to purchases made through our website for:
- physical goods
- digital products
- pre-order items
They are intended to give you clear information about how orders are placed, accepted, supplied, and managed. UK rules for distance selling require traders to provide key information such as pricing, payment arrangements, delivery information, and cancellation rights clearly before a customer places an order.
Nothing in these Terms & Conditions removes or limits any statutory rights you may have under applicable consumer law.
3. Eligibility to Purchase
By placing an order through our website, you confirm that:
- you are legally capable of entering into a binding contract;
- the information you provide is accurate and complete;
- you are authorised to use the payment method provided;
- you will use the goods or digital products only in accordance with these Terms & Conditions and any applicable law.
4. Products We Sell
We currently sell products that may include:
- physical goods
- digital products
- pre-order items
All product descriptions, images, and availability information are provided in good faith. We try to ensure they are accurate, but minor variations may occur, including in colour, packaging, print finish, or presentation.
Where a product is made available on a pre-order basis, the product listing should be read carefully, as release windows and dispatch estimates may differ from in-stock items.
5. Product Availability
All products are subject to availability.
We reserve the right to withdraw, suspend, limit, or amend any product listing at any time. If a product becomes unavailable after an order has been placed, we may cancel the affected part of the order and refund any amount paid for that item.
6. Orders
When you place an order through our website, you are making an offer to purchase the selected product or products.
After you place an order, you will receive an order confirmation email acknowledging that your order has been received. This does not necessarily mean that your order has been accepted.
An order is accepted when we confirm acceptance or begin fulfilment of the order, unless we notify you otherwise.
We reserve the right to refuse or cancel any order where:
- a product is unavailable;
- there has been an obvious pricing or listing error;
- payment cannot be authorised or is flagged as high risk;
- fraud, misuse, or unlawful activity is suspected;
- shipping or fulfilment is not reasonably possible;
- we are otherwise entitled to do so under these Terms & Conditions or applicable law.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled goods or services.
7. Prices
All prices displayed on our website are in GBP (£) unless clearly stated otherwise.
Prices are shown before checkout, and the total payable amount, including delivery charges where applicable, will be shown before you place your order. Consumers buying online must be given the total price and any delivery charges, or the way they are calculated, before the order is placed.
We reserve the right to change prices at any time, but changes will not affect orders already placed and accepted.
8. VAT
At present, Fervent Drift RPG & Fantasy Ltd is not VAT registered, and VAT is not currently charged on orders.
If our VAT status changes, our pricing and relevant policies will be updated accordingly.
9. Payment
Payment is taken immediately at checkout through Stripe.
Your order will not be processed until payment has been successfully authorised and received.
We do not normally store your full payment card details on our own systems. Payment processing is handled by our third-party payment provider.
If payment fails, is declined, or is reversed, we may suspend processing, cancel the order, or require an alternative payment method before continuing.
10. Fraud Prevention
We reserve the right to carry out reasonable verification checks in relation to any order.
Where we reasonably suspect fraud, unauthorised payment use, chargeback abuse, resale abuse, or other unlawful conduct, we may refuse, cancel, or delay an order while checks are completed.
11. Physical Goods
For physical goods:
- payment is taken in full at checkout;
- orders are generally processed within 2 to 5 working days, provided stock is available;
- shipping charges will be shown at checkout;
- delivery is sent using tracked services;
- delivery times are estimates unless expressly stated otherwise.
Unless another timeframe is agreed, goods sold online should generally be delivered without undue delay and within 30 days.
12. Digital Products
For digital products:
- payment is taken in full at checkout;
- access, download, or delivery is only provided after successful payment;
- you are responsible for providing the correct email address and any necessary technical capability to access the product;
- unless otherwise stated, digital products are supplied for personal use only.
The Consumer Rights Act 2015 includes specific rules for digital content supplied for a price, including remedies where digital content is faulty.
You must not, unless expressly permitted by us in writing:
- copy, reproduce, distribute, share, sublicense, resell, or commercially exploit digital products;
- alter or remove branding, notices, or copyright information;
- upload or redistribute digital products to any website, marketplace, file-sharing platform, or shared library;
- claim our content as your own.
All intellectual property rights in digital products remain with us or our licensors unless expressly stated otherwise.
13. Pre-Orders
For pre-order items:
- payment is taken in full when the order is placed;
- any release date, launch window, or estimated dispatch date is an estimate unless expressly stated otherwise;
- delays may occur due to manufacturing, supplier, freight, production, or other issues outside our reasonable control;
- if we cannot fulfil a pre-order, we will contact you and arrange an appropriate refund.
Where multiple pre-orders are placed for a single release, those items may be shipped as one package.
Where pre-orders relate to different releases, each pre-order may be shipped separately according to the relevant release schedule.
If a pre-order item is purchased together with an in-stock item, we may ship the order together or separately depending on product timing, stock, and operational requirements, unless stated otherwise on the product page or at checkout.
14. Shipping and Delivery
We ship within the UK and to selected international locations.
For some international destinations, we may use local or regional fulfilment or delivery partners to complete delivery on our behalf.
Shipping charges and available destinations will be shown at checkout. All deliveries are sent using tracked services.
Delivery times are estimates only unless expressly stated otherwise. We are not responsible for delays caused by:
- customs or import procedures;
- courier disruption;
- severe weather or transport problems;
- stock shortages;
- incorrect address details provided by you;
- circumstances outside our reasonable control.
Under UK consumer law, goods generally remain at the trader’s risk until they come into the physical possession of the consumer or a person identified by the consumer.
Additional shipping terms are set out in our Shipping Policy.
15. International Orders
For international orders, you are responsible unless we clearly state otherwise for:
- customs duties;
- import taxes;
- clearance fees;
- local handling charges imposed by the destination country.
International delivery times may vary and are not guaranteed.
16. Your Right to Cancel
Where the law gives you a right to cancel, you may cancel eligible online orders within 14 days of receiving the goods, without giving a reason. Online sellers must tell customers about this right, and failure to do so can extend the cancellation period.
To exercise your cancellation right, you must notify us clearly within the cancellation period.
You then generally have a further 14 days to return the goods after notifying us of cancellation, and we will process any refund due in line with applicable law and our Refunds & Returns Policy.
Your cancellation rights may not apply, or may be limited, in certain circumstances allowed by law, including certain:
- personalised or custom-made goods;
- sealed items not suitable for return for health protection or hygiene reasons once unsealed;
- digital content once supply has begun, where the required information and acknowledgements have been provided.
17. Returns and Refunds
Returns and refunds are governed by our Refunds & Returns Policy and your statutory rights.
Where a refund is due, it will usually be made using the original payment method unless otherwise agreed. The law also contains rules about refund timing for cancelled distance contracts and for digital content remedies where applicable.
We reserve the right to inspect returned items before issuing a refund where this is appropriate and lawful.
Nothing in these Terms & Conditions removes your legal rights in relation to faulty, misdescribed, damaged, or undelivered goods, or faulty digital content.
18. Faulty, Damaged, or Incorrect Items
If you receive an item that is faulty, damaged, incorrect, or not as described, please contact us as soon as possible.
Depending on the circumstances and your legal rights, you may be entitled to a repair, replacement, price reduction, refund, or other remedy.
For digital content, the Consumer Rights Act 2015 provides specific remedies, including repair or replacement in appropriate cases.
19. Promotions and Discount Codes
From time to time we may offer discount codes, bundles, or promotional offers.
Unless expressly stated otherwise:
- discount codes must be entered correctly at checkout;
- promotions cannot be exchanged for cash;
- only one code or offer may be used per order unless stated otherwise;
- promotions may be amended or withdrawn before an order is placed;
- misuse of a promotion may result in cancellation of the affected order.
20. Intellectual Property
All content on our website and in our products, including text, artwork, logos, designs, digital files, downloads, branding, product descriptions, and original materials, is owned by or licensed to Fervent Drift RPG & Fantasy Ltd unless stated otherwise.
You may not use our intellectual property except as permitted by these Terms & Conditions or with our prior written consent.
21. Acceptable Use of the Website
You must not use our website:
- for unlawful, fraudulent, or abusive purposes;
- to interfere with or damage the website or its security;
- to introduce malware, harmful code, or malicious material;
- to scrape, copy, harvest, or exploit website content in breach of our rights;
- to post or transmit unlawful, defamatory, threatening, hateful, or misleading content.
We may restrict or terminate access where we reasonably believe these Terms & Conditions or our website rules have been breached.
22. Reviews and Customer Content
If you submit a review, testimonial, comment, image, or other content to us, you confirm that:
- it is truthful and based on genuine experience where presented as a review;
- you have the right to share it;
- it does not infringe any third-party rights;
- it is not abusive, unlawful, defamatory, misleading, or obscene.
We may remove or refuse content at our discretion where we believe it breaches these Terms & Conditions, our policies, or applicable law.
Consumer and competition authorities have been paying close attention to misleading online practices, including fake or misleading reviews, so reviews should be genuine and handled transparently.
23. Privacy and Cookies
Your use of our website is also governed by our Privacy Policy and any Cookie Policy or cookie settings tool we make available.
The ICO says organisations using cookies and similar technologies must give clear information, and non-essential cookies generally require consent.
24. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
This includes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of rights that cannot legally be excluded or restricted.
Subject to the above, and so far as permitted by law, we are not liable for losses that are not a foreseeable consequence of our breach of these Terms & Conditions.
We are not liable for:
- business losses suffered by consumers or non-consumers using our website or products for commercial purposes;
- indirect or consequential losses;
- losses caused by events outside our reasonable control;
- losses caused by your misuse of products, digital content, or the website.
Consumer terms must be fair and cannot simply wave away legal responsibility in a one-sided way, so this clause should always be read subject to your statutory rights.
25. Events Outside Our Control
We are not responsible for delay or failure to perform any obligation where the delay or failure is caused by events outside our reasonable control, including:
- severe weather;
- natural disaster;
- industrial action;
- war or civil unrest;
- transport disruption;
- customs delays;
- supplier or courier failures outside our reasonable control;
- interruption to utilities or communication networks.
Where possible, we will take reasonable steps to minimise the effect of such events.
26. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in law, regulation, our products, our website, or our business operations.
The latest version will always be posted on our website with the updated date shown at the top.
27. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections available under the law of the part of the United Kingdom in which you live.
Any dispute relating to these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law allows otherwise.
